The App provides a method to enable customers who seek transportation to particular destinations to be connected with drivers. MyTaxio does not offer transportation services; instead, we are a technological service provider that uses an electronic stage to provide the services.
Access to, and use of, the app or website is free of charge. You will need to set up a customer account and give your payment details to access the services. Any declaration or other communication permitted or required by these conditions by MyTaxio will be in writing and sent to the email address that you gave when setting up your customer account and/or the app.
2. TRANSPORTATION SERVICES
To connect you to drivers, you will be asked to enter your location into the app. Where you enter your ultimate location; we will provide you with an estimated price for the journey, based on the information provided, and provide you with the availability of drivers. If you want to continue with your request for transportation services, you should select the order button, and you will be connected with a driver for transportation services, and this shall create an order. By selecting the order button, you will enter into an agreement for transportation services with a driver and be provided with their details via the app. For the avoidance of any difficulty, your agreement for transportation services will be with the driver selected and will not be with MyTaxio. You acknowledge and agree that MyTaxio is not a party to your agreement for transportation services.
You accept that your geo-location information must be provided by your device to allow us to provide the services. You accept and agree that your geo-location information will be obtainable by the app and when you are logged-in your location will be presented to MyTaxio and drivers.
Following a driver finishing an order, you will be able to rate your driver via the app. Where you preferred to rate your driver, you must provide accurate feedback on the driver to allow us to observe the quality of the transportation services they provide to users of the app. Drivers may also be allowed to rate you as a customer and such information may be used by drivers when determining whether to accept or reject your future orders. Customers must (and where appropriate customers must ensure their guests) at all times act respectfully and politely towards drivers and any other passengers of the vehicle.
In point of the transportation services, you will be charged the fees. No additional technology fee may be added. Where the fees are paid on a fixed fee basis, the amount of the fee will be notified via the app, and you will have the opportunity to place the order at your sole discretion at such fixed fees. As a provider of transportation services, all drivers are expected by MyTaxio to provide the transportation services in an active, efficient and safe manner. Once the transportation services have been completed, and payment is made, details of past journeys are available via the app.
If you disappoint to make payment of the fee either in full or in part MyTaxio may:
• Suspend your access to the services;
• Permanently delete your customer account and access to the services; or
• Continue to try to charge your chosen payment card or any other payment cards registered on your account for any outstanding fee(s) until such fee(s) have been paid in full.
If you select to make payment of the fee by cash and then fail to do so, you authorize MyTaxio to charge your payment card to recover such unpaid fees.
If you select a fixed fee payment and then, while the transportation services, need the driver to change his path in any matter whatsoever, including making any unscheduled halts or using an alternative route, the fixed fee may be recalculated to take account of such moves. Fees will be recalculated based on the meter, and such modifications to the fixed fee will be notified to you via the app.
If you are not waiting at the collection location when the driver comes, you will be priced the standby fee. If you do not arrive in 5 minutes, your order will be canceled, and you will be priced the cancellation fee and the standby fee.
From time to time, MyTaxio may run promotional offers or rewards for using the services and details of such promotions and bonuses shall be made available via the app, text message or email. MyTaxio will notify you of offers that you are eligible to accept from time to time and any additional promotional terms and conditions. Where a promotion offers customers or drivers a bonus for submitting or completing a set numbers of orders, you must not do anything in fulfillment of this promotion which may be deemed fraudulent. All orders must involve the provision of transportation services to bona fide customers, and you must not collude with drivers and/or create any fake or fictitious customer profiles and/or submit fictitious journeys to qualify for any promotional or bonus payment. MyTaxio reserves the right to report any fraudulent activities to relevant law enforcement authorities.
5. LIMITATION OF LIABILITY
MyTaxio shall not be liable for incidental, indirect, special, exemplary, punitive or consequential harms, including lost profits, lost data, personal damage or property loss related to, in connection with, or otherwise resulting from any use of the services, even if MyTaxio has been advised of the possibility of such damages. MyTaxio shall not be liable for any damages, liability or losses arising out of:
• your use of or dependence on the services or your inability to access or use the services
• any transaction or connection between you and any third party provider, even if MyTaxio has been advised of the possibility of such damages. MyTaxio shall not be liable for delay or failure in performance resulting from causes beyond MyTaxio’s reasonable control. You acknowledge that third-party transportation providers providing transportation services asked through some request brands may offer ridesharing or peer-to-peer transportation services and may not be professionally authorized or permitted.
MyTaxio services may be used by you to request and schedule transportation, goods or logistics services with third-party providers, but you agree that MyTaxio has no responsibility or accountability to you related to any transportation, goods or logistics services provided to you by third-party providers other than as expressly outlined in these terms.
The controls and disclaimer in this section do not mean to limit liability or modify your rights as a consumer that cannot be eliminated under applicable law.
If any part of these conditions is forbidden or found to be ineffective by any court or regulator, the other terms shall continue to apply to the maximum extent permitted by law.
7. THIRD PARTY RIGHTS
Rights under these conditions only accrue to a person party to these conditions. Thus, a person who is not a party to these conditions shall have no rights under the agreements (rights of third parties) act 1999 to implement any of its conditions, but this does not change any right or support of a third party which exists or is available apart from that act.
